Indian court bans the process of three instant divorce practiced by Muslims.

New Delhi: Indian Supreme Court ruled about the triple divorce process practiced by Muslim men declared as unconstitutional, it has been praised by Prime Minister Nirender Modi.

Prime Minister Modi tweeted, “The verdict has granted equality to Muslim women and is a powerful measure for women’s empowerment.”

It has been considered as the social violence if the court allowed men to practice three talaq “divorce” at once, to protect women rights for her personal liberty the law needed to be implemented.

Legal advisor Faizan Mustafah (the vice-chancellor of NALSAR University of Law in Hyderabad and a leading expert on constitutional law) said, “The law will not bring any chance in society, the sole purpose is to bring reform in the society.

“The judgement is progressive and beneficial for women rights.”

According to him, “The judges said that the law violated Article 14 and 21 of the Constitution, which are related to equality, and protection of life and personal liberty respectively.”

He added, “Muslims in India are governed by Muslim Personal Laws. India has a provision for personal laws for all religious communities.

“Personal laws cover marriage, divorce, succession, inheritance, maintenance, custody of children and adoption.

“Civil laws, by contrast, are applicable to all faiths.”

The judges said, “They were not going into the question of whether triple talaq(divorce) is Islamic or un-Islamic since it was arbitrary and gave too much power to the husband.”
